Indian Council Acts

Indian Council Act 1861

  • This led to the inclusion of Indian representatives in the process of law making Lord Canning nominated three Indians, the King of Benaras, Maharaja Patiala and Sir Dinkar Rao, to the Legislative Council in 1861.
  • The process of decentralization was started by reverting the legislative powers of the Bombay and Madras Presidencies Thus the Act reversed the trend of centralization introduced by the Regulating Act, 1773.
  • It gave statutory recognition to the 'Portfolio System' (Departmental System).
  • The Act of 1861 gave birth to Representative Institutions in India. A fifth member was included in the Viceroy's Executive Council, which was the rank of a jurist The Viceroy's Council was  empowered to make laws, under which Lord Canning introduced the Departmental System.
  • The Council of India Act 1861 gave the Governor General the power to issue ordinances for the first time, the duration of such ordinance was only six months.
  • The Viceroy also got the right to establish new provinces and change their boundaries through this act.

  • As a result of the revolution of 1857, the nationality that Nourished among Indians, the establishment of Congress in 1885 and the events of Ilbert Bill dispute compelled the British to pass the Indian Council Act 1892.
